Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," or "your") and Bytewisier ("we," "us," or "our"), governing your access to and use of our products and services, including Hisab, and any other applications or websites operated by Bytewisier (collectively, the "Service").
By creating an account, clicking "Sign Up," or accessing the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must not use the Service.
Description of Service
Bytewisier provides cloud-based business management software. Our primary product, Hisab, is an accounting and financial management platform that includes:
- Double-entry bookkeeping and general ledger management
- Sales management — invoices, quotations, sale orders, delivery challans, credit notes, POS
- Purchase management — purchase bills, purchase orders, debit notes
- Inventory and stock control across multiple locations
- Customer and supplier management with party ledgers
- Bank account management and reconciliation
- Financial reporting — trial balance, balance sheet, profit & loss, tax reports
- Shopify integration for automatic order synchronisation
- Business dashboard with KPIs and analytics
The Service is provided on a software-as-a-service (SaaS) basis, accessible via a web browser. No software installation is required.
Hisab is a financial record-keeping tool. It is not a substitute for professional accounting, tax, or legal advice. Always consult a qualified accountant or tax professional for compliance with your local regulations.
Account Registration
Eligibility
To use the Service, you must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction.
Account Information
You agree to provide accurate, current, and complete information when registering and to keep this information up to date. You are responsible for all activity that occurs under your account.
Account Security
- You must keep your password confidential and not share it with anyone.
- You are responsible for all actions taken under your account credentials.
- If you suspect unauthorised access to your account, you must notify us immediately at support@bytewisier.io.
- We are not liable for losses arising from unauthorised use of your account due to your failure to secure your credentials.
One Account Per Business
Each registered account corresponds to one business entity. You may add team members within a single business account. Creating multiple accounts to circumvent service limitations is not permitted.
Acceptable Use
You agree to use the Service only for lawful business purposes and in accordance with these Terms. You must not:
- Use the Service to record, facilitate, or conceal fraudulent, illegal, or unlawful financial transactions
- Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our infrastructure
- Introduce malware, viruses, or any code designed to disrupt, damage, or gain unauthorised access to systems
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Scrape, crawl, or use automated means to extract data from the Service without our prior written consent
- Resell, sublicense, or commercially exploit the Service without a written agreement with us
- Use the Service to impersonate any person or entity
- Violate any applicable local, national, or international law or regulation
We reserve the right to investigate and take appropriate action — including account suspension or termination — for any violation of this section.
Your Data
You Own Your Data
All financial and business data you enter into Hisab remains your property. We claim no ownership over your invoices, transactions, accounts, or any other content you create within the platform.
Licence to Process
By using the Service, you grant Bytewisier a limited, non-exclusive licence to store, process, and transmit your data solely for the purpose of providing the Service to you. This licence ends when your data is deleted from our systems.
Accuracy of Data
You are solely responsible for the accuracy, completeness, and legality of all data you enter into the Service. Bytewisier is not responsible for errors, omissions, or financial consequences arising from incorrect data entry.
Data Export
You may export your data in PDF or CSV format at any time from within the application. We will not hold your data hostage — if you close your account, you have 30 days to request a full data export before all data is permanently deleted.
Third-Party Integrations
When you connect a third-party service (such as Shopify) to Hisab, you authorise us to access and sync data from that service on your behalf. You are responsible for ensuring you have the right to connect that third-party account. We are not responsible for data accuracy issues arising from third-party platforms.
Free & Paid Services
Hisab offers a free tier to get started. We may introduce paid plans with additional features, higher usage limits, or priority support in the future.
- Free tier: Access to core features as described on our pricing page. No payment information required.
- Future paid plans: If and when paid plans are introduced, pricing will be clearly communicated. Existing free accounts will not be automatically charged.
- Plan changes: We reserve the right to modify, limit, or discontinue any tier of the Service with at least 30 days' prior notice.
All payments, if applicable, are non-refundable unless otherwise stated in a separate billing agreement or required by applicable law.
Service Availability
We work hard to keep Hisab available and reliable, but we do not guarantee uninterrupted, error-free access. The Service is provided on an "as available" basis.
- We may perform scheduled maintenance that temporarily restricts access. We will endeavour to perform maintenance during off-peak hours and provide advance notice where possible.
- We are not liable for downtime, data unavailability, or service interruptions caused by circumstances beyond our reasonable control, including third-party infrastructure failures, internet disruptions, or force majeure events.
- We do not offer a Service Level Agreement (SLA) for uptime under the free tier.
Intellectual Property
Our Property
The Hisab application, including its software code, design, user interface, branding, logos, and all related intellectual property, is owned exclusively by Bytewisier and protected by applicable copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes, subject to these Terms.
Your Property
You retain all intellectual property rights in the content and data you create, upload, or enter into the Service. Nothing in these Terms transfers ownership of your data to us.
Feedback
If you submit suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free licence to use that feedback to improve our products, without any obligation to compensate you.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Service will meet your specific business or compliance requirements
- Warranties that reports generated are suitable for filing with any tax authority or regulatory body without review by a qualified professional
- Warranties that the Service will be error-free, uninterrupted, or free from security vulnerabilities
You are responsible for verifying the accuracy of all financial data and for ensuring compliance with all applicable laws and regulations in your jurisdiction.
Limitation of Liability
To the maximum extent permitted by applicable law, Bytewisier and its directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Financial losses arising from incorrect data entry, report errors, or reliance on Hisab output without professional review
- Losses arising from unauthorised access to your account due to your failure to maintain credential security
- Service interruptions, data loss from technical failures, or acts of third-party service providers
In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, our liability is limited to the maximum extent permitted by law.
In any case, our total aggregate liability to you for any claims arising from your use of the Service shall not exceed the greater of (a) the total amount you paid to Bytewisier in the 12 months preceding the claim, or (b) USD 100.
Indemnification
You agree to indemnify, defend, and hold harmless Bytewisier and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your violation of these Terms
- Your use or misuse of the Service
- Your violation of any applicable law or regulation
- Any data you enter into the Service that infringes the rights of a third party
Termination
Termination by You
You may close your account at any time from the account settings page or by contacting support@bytewisier.io. We recommend exporting your data before closing your account. Upon closure, your data will be permanently deleted within 30 days.
Termination by Bytewisier
We may suspend or terminate your account immediately and without prior notice if:
- You violate any provision of these Terms
- We are required to do so by law or a government order
- We reasonably believe your account has been compromised or is being used fraudulently
- Continued provision of the Service to you creates legal risk for us or other users
Where termination is not due to a breach on your part, we will provide at least 30 days' notice and give you the opportunity to export your data.
Effect of Termination
Upon termination, your access to the Service will cease and your data will be scheduled for permanent deletion. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and indemnification — will remain in effect.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable law. We encourage you to contact us first to resolve any dispute informally before pursuing formal proceedings.
If a dispute cannot be resolved informally within 30 days, both parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through the courts of competent jurisdiction.
Nothing in this section prevents either party from seeking emergency injunctive relief to protect intellectual property or confidential information.
Changes to These Terms
We may update these Terms as the Service evolves. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to all registered users at least 14 days before changes take effect
- Display a notice within the application when you next log in
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
